Goa CB plan to trap Aires Rodrigues, add Non-bailable IT Act in Goa Sex Scam-Sexual Harassment Case

Even as the Goa Crime Branch has forcefully opposed social activist and Adv. Aires Rodrigues’ anticipatory bail plea on the grounds that it is not maintainable in an FIR in which the sections applied are bailable, Crime Branch sources secretly told India Scribes Tv journalist FLYNN REMEDIOS that the cops plan to call Aires Rodrigues for interrogation and apply Non Bailable sections of  the Information Technology Act at the last minute and arrest Rodrigues.

His ABA pending in the District & Sessions court of North Goa will be disposed off or he may have to withdraw it on the grounds that it is not maintainable under Section 438 CrPC in bailable offences. The cops may even give an undertaking to the court that since the offence is bailable, they do not want to arrest the accused. However, after interrogation, the cops will claim that more facts have surfaced, apply the IT Act and maybe other IPC provisions making the case non bailable and then arrest Rodrigues at the Crime Branch.

After arrest Rodrigues would be produced in the JMFC at Panaji and under the IT Act the Crime Branch is bound to get police custody for at least 2-3 days on the grounds that the computer and mobile phone used for allegedly uploading the images and video need to be seized under panchnama, etc.  This is the plan of the Crime Branch to humiliate and discredit Rodrigues in the present case, claim knowledgeable sources.

According to the Times of India, the Crime branch of the Goa police in its reply to the sessions court, Panaji, with reference to social activist Aires Rodrigues’ anticipatory bail application in the alleged sexual harassment case, said that since the offence is bailable, the same cannot be filed. Rodrigues had filed for anticipatory bail on Friday.

Crime branch PI Dattaguru Sawant in the reply filed on Saturday said their investigations are in the preliminary stage with interrogation, search and recovery yet to conducted. “The accused has not co-operated with the investigating agency,” the reply stated, adding that Rodrigues has avoided appearing before it at the appointed time as mentioned in the notice for appearance. Stating that the accused, despite being a lawyer, had ‘outraged the modesty of a woman’ and ‘defamed her in society’, Sawant said the crime is ‘evil in nature’.

CB submitted to the Court that Rodrigues has not cooperated with the investigating agency and also avoided to appear at the time mentioned in the summons for appearance. Crime Branch said that the investigation in the case is at preliminary stage and interrogation, search and recovery has to be carried out.
CB also said that the application for anticipatory bail is not maintainable as they are probing a cognizable offence. Principal Sessions Judge Irshad Agha adjourned the hearing to December 11. A woman has accused Mr. Rodrigues of sexually harassing her and outraging her modesty by posting her picture on Facebook and linking her to an alleged sex scandal involving minister Vinod Paliencar.

  1. Dattaguru Sawant is a known rogue and unfit policeman in the Goa police force. He was dismissed twice and at the instance of Manohar Parrikar reinstated which is totally against the law as the this Dattaguru who is a parking attendant does not meet the criteria required to join the police force. He is now trying he tricks to grab Aires who has exposed him vehemently. It is high time the whole nation of Goa comes out on the streets to kick this guy out via supreme court and manohar parrikar too be punished for the illegal acts of forcing this Dattaguru in the department.
